Terms of Service

Review the terms and conditions for using the Recoup platform.

Effective Date: 1st January 2026

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Posha Healthtech India Pvt Ltd (“Posha Healthtech,” “Company,” “we,” “us,” or “our”) regarding your access to and use of the Recoup post-discharge care mobile application (“App”) and related services (collectively, the “Services”).
By downloading, accessing, or using the Recoup App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of a hospital or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not access or use the Services.
2. Eligibility
To use Recoup, you must:
  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Have been provided access to the App by an authorized healthcare provider or hospital (“Hospital Partner”) as part of your post-discharge care plan.
  • Possess the legal capacity and authority to enter into this agreement.
  • Provide accurate, current, and complete information during registration and maintain its accuracy.

3. Nature of Service & No Emergency Service

Recoup is a non-emergency, post-discharge support tool.
  • It is NOT a medical device, nor does it provide medical diagnosis, treatment, or emergency healthcare services.
  • IT IS NOT INTENDED FOR MEDICAL EMERGENCIES. If you experience a medical emergency, such as chest pain, severe shortness of breath, sudden weakness, or any other acute medical crisis, you must IMMEDIATELY CALL YOUR LOCAL EMERGENCY NUMBER (e.g., 108, 112, 911) or go to the nearest emergency room.
  • The App facilitates communication of your self-reported recovery progress to your care team but does not guarantee real-time monitoring or immediate response. Your care team will respond to your updates during their regular working hours as per their protocols.
  • Any information, guidance, or reminders provided by the App are for general wellness and informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always follow the specific instructions of your treating physician.
4. User Account & Security
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You agree to notify us immediately at support@recoupapp.com of any unauthorized access to or use of your account.
  • We reserve the right to disable any user account at any time if, in our reasonable opinion, you have failed to comply with any provision of these Terms.

5. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App for any purpose other than your personal post-discharge recovery management.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Attempt to probe, scan, or test the vulnerability of the App or any associated system or network.
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.

6. User Content & License

You retain ownership of any personal data and health information you input into the App (“User Content”). However, by submitting User Content, you grant Posha Healthtech a non-exclusive, royalty-free, worldwide license to use, host, store, reproduce, modify, and transmit such content solely for the purpose of (i) providing the Services to you, (ii) sharing it with your designated Hospital Partner and care team as you intend, and (iii) generating de-identified, aggregated data for service improvement and research, as outlined in our Privacy Policy.

You are solely responsible for the accuracy, quality, and legality of your User Content.

7. Intellectual Property Rights
The Recoup App, its original content, features, functionality, design, and logo are owned by Posha Healthtech and its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.
8. Privacy

Your privacy is important to us. All information you provide to us or that we collect through your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices regarding your personal and health information.

9. Disclaimer of Warranties & Limitation of Liability
  • DISCLAIMER: THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSHA HEALTHTECH, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (IV) ANY STATEMENTS OR CONDUCT OF ANY HOSPITAL PARTNER OR CARE TEAM MEMBER; OR (V) ANY OTHER MATTER RELATING TO THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT OF ONE HUNDRED INDIAN RUPEES (INR 100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Posha Healthtech and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content or your violation of any applicable law.
11. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately. Provisions of these Terms which by their nature should survive termination (including, without limitation, ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.
12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be subject to the exclusive jurisdiction of the courts located in [City, State, India], where Posha Healthtech has its registered office.

13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days’ notice prior to any new terms taking effect, by posting a notice in the App or sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
